So, you have been charged with, or think you may be charged with, a federal crime.  What do you do?  There is an important truth behind the admonition, “Don’t make a federal case of this.”  That is because federal crimes are often very serious, carrying a far greater risk that the person accused will be convicted and sentenced to a long period of incarceration.

You need an experienced aggressive Federal Criminal attorney in your corner.  This is true for several reasons:

First, Federal law enforcement is famously thorough and efficient.  Certainly case agents and federal prosecutors  (also known as Assistant United States Attorneys or AUSAs) make mistakes, but, on the  whole,  federal agents investigate thoroughly and AUSAs prosecute with great skill and determination.    Once they decide to prosecute a case, they do not like to let it go.

Second, federal sentences are frequently extremely harsh.   In drug cases, for example, people charged with  possession with intent to distribute narcotics usually face a mandatory minimum sentence of five or ten years and sometimes even more.  In white collar cases, mandatory minimum sentences can also apply.  A person convicted of some types of fraud in tandem with aggravated identity theft may face a mandatory sentence of two years over and above whatever sentence they receive on the fraud conviction.  People convicted of fraud often face double digit sentences depending on the amount of the “intended loss.”

This is not to say that federal charges are hopeless.  They absolutely are not.  Experienced federal criminal defense lawyers can make a huge difference in the outcome of a case.    An experienced and effective advocate can lift  the cloud of  hopelessness that falls on the unlucky person accused of a federal crime.  Many seemingly hopeless cases can be resolved successfully before trial.    Others can be won at trial or in such a way that a lenient sentence results.
